GENERAL TERMS AND CONDITIONS

THIS AGREEMENT CONTAINS WARRANTY DISCLAIMER AND OTHER PROVISIONS THAT LIMIT OUR LIABILITY TO YOU. PLEASE READ THESE TERMS CAREFULLY AND ENTIRELY BECAUSE BY BROWSERING OUR WEBSITE AND/OR USING OUR SERVICES, YOU ARE AGREEING TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO ALL THE TERMS SET FORTH HEREIN, PLEASE IMMEDIATELY LEAVE AND DISCONTINUE USING OUR WEBSITE.

1. Acceptance of Agreement

1.1. The present General Terms and Conditions regulate the contractual relationship for the provision of services according to the selected service offer between the Green Card Group LLC, with registered office in 1309 Coffeen Avenue, STE 1200, Sheridan, Wyoming 82801 and the customer.

2. Scope

2.1. The general terms and conditions apply to the entire range of services and products offered by Green Card Group LLC, which are distributed via the websites at www.green-card-network.com and www.usa-visa-service.com.

3. Terms of Participation

3.1. The general terms and conditions are valid at the time the contract is concluded and apply between us and the customer when participating in the Green Card lottery and when applying for a US visa.
3.2. Supplementary terms and conditions of the customer that are not contained in the general terms and conditions are not recognized.

4. Registration and conclusion of contract

4.1. Our offers on the Internet are non-binding.
4.2. When participating in the Green Card Lottery, the customer confirms the offer after entering their data by selecting the desired service pack.
4.3. The registration process can be canceled at any time before the customer has made a payment.
4.4. As soon as the customer has submitted his data after completing the payment, he will receive a registration confirmation via e-mail. This confirms the customer's order to participate in the Green Card lottery as part of the selected service package.
4.5. This registration confirmation does not constitute a binding acceptance to the Green Card Lottery and is only intended to inform the customer that the order has been received.
4.6. The customer is responsible for ensuring that the information entered (e.g. about level of education or country of origin) meets the requirements for obtaining a Green Card. A proof of education and marital status must be submitted at a later point. For countries of origin that are excluded from the Green Card Lottery, please visit usa-visa-service.com/countries.
4.7. If the customer does not have the required previous education (at least 12 years of formal schooling, high school diploma or a specialist training for at least two years), we advise the customer not to take part in the Green Card Lottery.
4.8. A contract is only concluded when we confirm the order in writing.
4.9. Registration for the Green Card lottery is only possible if we have received all of the requested customer's information within the applicable time frame.
4.10. Should the U.S. authorities change the conditions of participation during the application period, the registered participant will be informed of the changed conditions as soon as possible.

5. Service

5.1. Green Card Group LLC is not affiliated with any U.S. government agency.
5.2. Green Card Group LLC offers its customers assistance in registering for the Green Card Lottery and in applying for a US visa. The customer has the opportunity to participate in the Green Card lottery free of charge within a certain time period on the official government website https://dvprogram.state.gov/.
5.3. Green Card Group LLC does not guarantee the customer a certain success for the receipt of a Green Card. The decision to select the winners will be made by U.S. authorities.
5.4. The customer can notify us about a change in his personal data in writing (by email to support@green-card-network.com).
5.5. Changes must be submitted in time (no later than 10 days before the submission deadline) and are only considered accepted once the customer has received an e-mail confirming these changes. Information about the registration period can be found in the e-mail with the registration confirmation.
5.6. As soon as the results of the Green Card selection process are available, they will be passed on to the customer.
5.7. The scope of the service depends on the service package selected: "Standard, Advanced or Advanced + Flight".
5.8. In the event that a participant was selected in the Green Card Lottery, the "Advanced" service package also includes submitting form DS-260 and additional support leading up to the issuance of the Green Card. The customer is responsible for ensuring that the necessary steps and deadlines are obeyed.
5.9. If the “Advanced + Flight” service package was selected, we will book a free flight for the customer in case his Green Card application was approved. The destination and the departure date are determined in consultation with the customer. The booking is made after the immigrant visa was issued. The airline and class of travel will be selected by us.
5.10. Participation in the current DV-2025 Green Card Lottery is only possible if we have received an application with complete information (including all requested documents) from the customer no later than 10 days before the submission deadline (October 1st 2023).
5.11. If the US authorities change the conditions of participation during the application period, the customer will be informed. In this case, participation in the Green Card Lottery may not be possible. A refund of the service fee cannot be provided.

6. Right of Withdrawal in case of an unforeseen event

6.1. If participation in the Green Card Lottery or submission of the data to the responsible US authority is not possible due to an unforeseen serious event (e.g. war, embargo, failure of the electronic infrastructure, other technological restrictions, changes in the relevant laws or the cessation of the green card program in the current registration period), both contracting parties can withdraw from the contract by means of a written notification. In the case of cancellation, the customer will be refunded the amount paid minus a processing fee of 25 dollars.

7. Right of Withdrawal

7.1. The customer can cancel an order in writing within three days without giving reasons.
7.2. The cancellation period runs from the date of conclusion of the contract.
7.3. Sending the cancellation in good time is sufficient to meet the cancellation deadline.

7.5. The customer's right of withdrawal expires prematurely if we have already started to perform the service.

8. Customer Obligations

8.1. The customer agrees to submit all the data and documents required to participate in the Green Card Lottery in a timely manner.
8.2. The customer confirms that the information provided about education, marital status and country of origin are complete and correct.
8.3. If the data submitted (e.g. photos) does not meet the requirements of the Green Card Lottery, the customer will be informed. The customer is obliged to submit the requested data immediately in order to enable participation.
8.4. In the event of a change in the information required for registration during the application period, the customer is obliged to provide us with all the requested documents in due time and in the required form.
8.5. The customer is obliged to immediately notify us of any changes to his personal data that are relevant in obtaining a U.S. visa.
8.6. The customer is not authorized to register more than once or with different names and addresses. We do not check the accuracy of the information submitted by the customer.
8.7. The customer agrees to pass on further data and evidence to us in the event his application was selected.
8.8. The customer confirms that he transfers all rights of use of the submitted photos and documents to us.
8.9. The customer confirms that there are no third-party rights (e.g. copyrights) to the photos. Should third parties nevertheless assert claims against us due to unauthorized use of the photos, the customer is obliged to indemnify us from claims.
8.10. The customer agrees to submit further data to the U.S. authorities when instructed and visit the US consulate within the specified deadlines, otherwise the right to a Green Card will expire.
8.11. If the customer violates his contractual obligations, we are entitled to withdraw from the contract and/or to demand compensation for non-performance.

9. Costs

9.1. The prices listed on our website are the binding gross price.
9.2. The prices include the statutory value-added tax as well as all additional costs incurred for the processing of the customer order.
9.3. The prices include the participation in the Green Card Lottery as well as expenses for counseling. In case of a win and depending on the service package selected, the cost of a flight to the USA (required to issue the Green Card) is also included.
9.4. Costs incurred by the customer in connection with the application process, e.g. costs for the translation of accompanying documents, fees at the responsible US authority, costs for official or notarial certifications, etc. are not included.

10. Payment

10.1. The service fee is due for payment after the entry form has been processed.
10.2. The customer can choose between two payment methods: credit card or PayPal.
10.3. If we do not receive the service fee within 14 days of processing the entry form, the customer is in default of payment. In this case, we are entitled to demand compensation for non-performance and/or to withdraw from the contract. We reserve the right to withhold performance until full payment has been made. Offsetting is only possible if the customer's counterclaims have been legally established or recognized by us.

11. Limitation of Liability

11.1. Any liability of Green Card Group LLC is excluded in case of a partial or total impossibility of providing the service due to external reasons (e.g. in the event of catastrophes, unforeseeable circumstances, in the event of a fault on the part of third parties or the customer, events such as war, embargoes, failure of the electronic infrastructure, other technological restrictions, changes in the relevant laws or the termination of the Green Card selection process in the current DV selection year).
11.2. We are only liable for other damages in the event of breaches of contractual obligations.
11.3. We have no control over changes in applicable laws governing the operation of the Green Card Lottery and are not responsible for failure to schedule an appointment to appear at the US Consulate, which may result in forfeiture of a Green Card issuance.
11.4. Links to Other Websites Our Website may contain links to third-party websites. Inclusion of links for any website on our Website does not mean that we endorse, guarantee or recommend the services, information and content of such third-party websites.

12. Linking to Our Website

You may provide links to our website if you do not remove or obscure any portion of our website by framing, your website does not contain illegal or pornographic activity, and you immediately cease providing links to our website upon our request.

13. Disclaimer

The material on our websites is for informational purposes only and does not constitute legal advice.

14. Errors and Changes on our Website

We do not warrant the information available on our Websites will be correct, accurate, timely, or reliable. We reserve the right to change any content used or contained in our Website or Products at any time without notice.

15. Privacy

15.1. By signing up, the customer authorizes us to process the personal, including sensitive, data necessary for the fulfillment of this contract. The personal data that we obtain may only be used for the execution of this contract. Any other use is therefore excluded.
15.2. Customer data will be passed on to the US authorities for the execution of the order. We would like to point out that the responsible US authority is not subject to the high data protection standards of the European Union.
15.3. The customer can request information about his stored data and their correction or deletion at any time. Inquiries of this nature should be directed to: support@green-card-network.com

16. Exclusive Venue and Governing Law

16.1. The District Court of Sheridan, Wyoming, will have exclusive jurisdiction for any dispute regarding the interpretation, execution and termination of the order.
16.2. Anything not provided for in these GTC, express reference is made to the applicable legislation.

17. General Provisions

17.1. The eventual partial or total ineffectiveness and/or nullity of one or more clauses of these GTC shall not affect the other clauses, which shall be considered fully valid and effective.
17.2. These General Terms and Conditions replace any other previous agreement that may have existed between us and the customer that had the same subject. Regulations or supplements that deviate from these General Terms and Conditions are only valid and effective if they are expressly confirmed in writing by both parties.
